Twice as Many People Qualify for Overtime
THE OBAMA ADMINISTRATION CONTINUED its
regulatory barrage against businesses in May. The
U.S. Department of Labor announced a final rule that
more than doubled the salary threshold to qualify
for overtime pay. Effective Dec. 1, workers earning
$913 weekly or $47,476 annually now qualify for
overtime pay. It is more than double the current
salary threshold of $23,660.
Employees above the salary threshold may still
be eligible for overtime pay if their duties are
not exempt under the executive, administrative
or professional (EAP) standard. The rule does not
affect hourly employees, who must already be
paid overtime.
The Labor Department estimates that this rule
extends the right to overtime pay to 4.2 million
workers who are currently exempt. Additionally,

(WOTUS) rule is currently under a judicial stay preventing implementation, NSSGA continues to keep
pressure on Congress to fight this regulation that
would extend the Environmental Protection Agency's
jurisdiction over many areas previously not considered waters and increase permitting costs for
aggregates operations and their customers.
Fiscal 2017 appropriations bills working through
the U.S. House of Representatives and U.S. Senate
at the time of this magazine's publication include
measures to prevent the EPA from enforcing the rule.
Additionally, during a Senate Environment and
Public Works Subcommittee hearing held in late May,
Sen. Deb Fischer, R-Neb., said that "every taxpayer
has to pay more because of these rules in order to
construct or maintain a road."
Also, in a House Agriculture Subcommittee on
Conservation and Forestry hearing held the week
of May 16, witnesses discussed impacts of WOTUS
on small family farms. While the focus was on agriculture and not building materials or construction industries, the rule's uncertainty and lack
of clarity are themes that are universal to many
industry sectors.

will become harder and more expensive to build.

the rule increases existing overtime protections for
5.7 million white collar and 3.2 million blue collar
salaried employees whose entitlement to overtime
pay will no longer rely on the EAP duties test.
Another provision in the rule mandates that the
Labor Department index future salary thresholds
to inflation every three years. Future updates to
overtime salary thresholds will automatically occur
every three years, beginning Jan. 1, 2020.
A coalition of 17 business groups, including NSSGA,
wrote to Congress and urged lawmakers to block
the overtime change. These organizations claim
that companies may switch some salaried workers
to hourly positions to afford the new threshold. As
a result, employees may be assigned fewer hours
and have to clock in and out instead of the current
flexibility they enjoy as salaried employees.

NSSGA MEMBERS FACE A brutal regulatory environment, and there are some lawmakers on Capitol Hill who
don't fully understand the value of aggregates operations in their districts. NSSGA invites members to come
to Washington, D.C., this September for critical meetings on regulatory issues and meetings with members
of Congress. Registration is now open for the second
annual NSSGA Safety and Environment Meetings and
Fly-In, Sept. 12-14 at the Hyatt Regency on Capitol Hill.
Attendees will have the chance to discuss important
issues with peers and association experts during the
three-day event. A meeting of the Safety & Health
Committee will address threats to worker health, MSHA
enforcement and the agency's anticipated rulemaking on workplace exams. The Environment Committee
meeting will provide updates on the Environmental
Protection Agency's controversial Waters of the U.S.
rule in addition to air, sustainability and Endangered
Species Act issues.
Anchoring the gathering will be visits to the Capitol
offices of key members of Congress. NSSGA will work
to set up meetings with key members of Congress and
provide all attendees with a political briefing so that
advocating for the industry is as easy as possible. Visit
