Marijuana in the Workplace:

What Employers
Should Do Now

Abrams discussed current challenges
regarding workplace safety and substance abuse in a session called Medical & Recreational Marijuana: Will Your
Workplace Go To Pot?
With medical and recreational marijuana legalization on the rise, employers may encounter issues related to
off-the-job conduct and need to determine when workers pose a "direct threat
to safety" as a result of marijuana use,
Abrams said. As the federal government's position on enforcement continues to evolve, navigating court decisions
for workers has proven challenging.
Here's what Abrams urged employers
to do now to address issues related to
marijuana and safety in the workplace:
Audit and update
current policies
Abrams highlighted that although
marijuana remains illegal at the

* 30 states including the District of Columbia have legalized medical marijuana
* 10 states including the District of Columbia have legalized recreational
marijuana
* At least 12 states are currently considering legislation to legalize medical
and/or recreational marijuana, including New Jersey, Michigan, Delaware,
Rhode Island and Connecticut
* A recent Gallup poll showed support for legalized marijuana currently stands
at over 64 percent in the U.S.

federal level, many states have
recently changed its legalization status. Over 42 percent of Americans now
live and work in states where medical
marijuana has been legalized, and 21
percent live in states where recreational marijuana is now permitted
under state law.
"Now is the time to take a hard look
at your organization's policies," Abrams
said. A careful review of state laws in
your company's jurisdiction is also a
good idea, since under the Americans
with Disabilities Act (ADA) a company
may need to provide reasonable accommodation for individuals with a prescription for medical marijuana.
Abrams recommended that an organization's drug-free workplace policy
be clear and direct. It should include
a rationale for the policy, prohibited
behaviors, substances covered and
employees affected. It should also
include, in the event an employee
violates the policy, consequences of
such a violation, enforcement means
and the availability of assistance.

Substance abuse in the workplace
is a serious and pervasive problem
in the U.S. It's estimated between 10
and 20 percent of the nation's workers
who die on the job test positive for
