Dates Set for
WOTUS Actions
UPDATING AND CLARIFYING THE
Environmental Protection Agency's
(EPA's) Waters of the U.S. rule is high
on the Trump administration's "To Do"
list, according to the Spring Regulatory
Agenda. Released in May, the agenda
outlines the actions federal agencies
intend to prioritize in the coming year.
NSSGA attended a meeting at the
White House on May 10, 2018, as part
of ongoing efforts to stress the importance of a rule that protects the environment and is clear for operators. The
EPA, according to the agenda, has targeted August 2018 to release a proposed
rewrite of the 2015 Waters of the United
States Rule and finalize the new rule
in September 2019. This rewritten rule
will replace the 2015 WOTUS rule that
would have regulated dry streambeds
and isolated waters and posed a hardship to companies in the industry. EPA
will still need to officially withdraw the
2015 rule, and that action is expected
in November 2018.

Regulations
and Funding
BILL SCHMITZ OF GERNATT Gravel
Products, Inc., in Collins, N.Y., testified on behalf of NSSGA during an
April 25, 2018, hearing on "American
Infrastructure and the Small Business
Perspective." Schmitz told the House
Small Business Committee that consistency and clarity should be a priority in federal decision-making. He
also emphasized the importance of
regulatory reform and a strong federal
investment in efforts to fix the nation's
crumbling infrastructure.

the Highway Trust Fund yet again, the
impact on small businesses is greater.
Especially in our industry, since we
provide the material and we use the
system," said Schmitz. "We need a consistent and steady direction from our
federal partners."
Schmitz told the committee that
small businesses like Gernatt are significantly affected by unclear regulations,
permitting and federal infrastructure
funding decisions. "Like 70 percent of
NSSGA members that are small businesses, at Gernatt, we do not have the
resources that larger companies use to
comply with confusing, overlapping and
unnecessary regulations," Schmitz said.

MSHA Adding
Time to Comply
with Exams Rule
MSHA TOLD NSSGA THAT the agency
will not issue citations related to the
new Workplace Exams Rule until Oct.
1, 2018. This move will give operators
time to understand the rule and give
the agency time to provide additional
compliance assistance. However, the
agency may issue citations in the case
of extremely dangerous hazards.
MSHA published a final rule on
Examinations of Working Places in
Metal and Nonmetal Mines on April
9, 2018. The rule went into effect
on June 2, 2018, and reflects the
somewhat positive changes proposed in September 2017. While
NSSGA remains concerned about
some aspects of the rule, we are
pleased MSHA has adjusted the
enforcement schedule.
