Marine Fisheries Service (NMFS), collectively "the Agencies," are responsible for administering the Act and for developing recovery plans and designating critical habitat for each species. To date, there are more than 1,300 flora and fauna species currently designated as endangered or threatened. Proposed projects or actions occurring on federal lands or requiring a permit or approval by a federal agency2 also require a qualified biologist to assess the project area for suitable habitat for species listed under the Act. If a suitable habitat is found, the Agencies may require a focused survey to determine the presence or probable absence of the species. Findings of any required project assessment and focused survey are reviewed by the Agencies, which then issue a Biological Opinion that includes measures and mitigation actions required to avoid or minimize impacts to the endangered species. The USFWS decided rather to primarily focus protections around known populations of northern long-eared bats, including maternity colonies and hibernacula, while also restricting tree clearing activities when bats may be rearing their young within areas affected by white nose syndrome. Resources are Available The USFWS has provided an online tool to initiate the consultation process for projects that may impact the bats and to help ensure that businesses comply with the Act. Where project schedules cannot be adjusted, the Agencies may require focused surveys like acoustic monitoring or mist netting to further assess the presence of northern long-eared bats.
